One of my friend got their Fingerprinting letter and the last name is misspelled. What should they do go ahead and take it to the FP office or call USCIS and get it corrected.

I had been in H-1B status and was laid off. My H-1B was withdrawn by my company on 12/31/2010. I applied for COS to B2 and received the USCIS receipt notice on Dec 17th, a few days before my H-1B was withdrawn.
Later on Feb 2nd, 2011, I received the approval notice from USCIS for B2 valid from 02/02/2011 to 04/29/2011(I had informed in my application that this would be my date of departure.) My question is: What status would I be from the date my H-1B was withdrawn till the B2 validity start date?

I have this very tough situation.
I have an approved I -140 from previous employer and 6 years is over in USA.
I got a H1B transfer to a different employer last year ( 2009 ) based on this approved I 140 ( H1B was approved around Aug 2009 - given till March 2011 ).
Now I filed for another H1B transfer to another employer. But around September 2009, the previous I 140 was revoked ( this revocation is normal one and not for fraud ). I didn't know about that. So an RFE came for the new H1B transfer since my I 140 was revoked. I don't have a GC on file right now. I had the impression that normal revocation of I 140 doesn't effect H1B transfer. PLEASE HELP!! What are my options?

My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

Hi I am currently working as a contractor at a client from company C1
C1 applied for my H1B last year and application is still pending + also added Premium Proc. last week, Application Still Pending
At the same time company C2 applied my H1B last year and H1B approved but did not get the documents from USCIS, and applied for "Response on Approved Petition", That is still pennding(But Yes The petition is approved)
But Fortunately or Unfortunately , I got a permananent job with a new company.
I can start working with that company on OPT, and he will apply a new H1B this year.
But , Instead of that Can I get one of my H1Bs transferred?
Or is there a better way to handle this situation?
I know its a mess... Can some one suggest me how to clear this mess?

I am in AOS with priority date of EB2 Dec 2006. We are moving out of USA due to spouse getting a job outside of USA. If we want to retain our priority date and green card, what are we supposed to do before and after we leave USA?
In case we want to make temporary visits to the USA, do we have to apply for visitor visa? I am assuming that we will not have AP since we are not inside USA. Will we even get a visitor/business visa since we have an immigrant visa which is pending with USCIS?

Now my story.
I am going to apply in next H1B quota and was having below queries:

I think we need to expose employers who are taking advantage of us in different ways just because we are stuck with them due to retrogression. This way if we cannot change the legislation right away we can atleast scare the crooks by exposing them so that they cannot trap new people.

Thanks for looking at my questions. I have an approved eb2 case with priority date 11/2007. I am waiting for eb2 India to become current for applying for EAD for my wife. She applied for medical residency and the programs she got calls for are sponsoring J1 visas only. I have a phd from US university and applying for EB1 OR through a semi conductor company anyway.
I am in dilemma whether to apply for EAD for my wife or let her go on J1. J1 has implications later for medicine students but given the randomness of USCIS, I am never sure when eb2 date would be 11/2007 for eb2 485 or denial of eb1 or application.
Please advise me over this dilemma.

Correct me I am wrong here:
AP allows you to enter US without a valid visa.
EAD allows you to work in US for any employer.
Untill and unless someone utlizes his EAD, he is still on H1 (if he has valid H1) doesn't matter he enters US using AP. Am I correct?
Then question arrises, If H1 holder changes his job then he needs to transfer his H1 only and not use EAD. Is this possible to have H1 renewed and transfered even though one has EAD approved, meaning is it compulsory to use EAD one you get it?

I have a situation where I need to dump my emp after working for almost 6 years as I am getting new opportunity which requires emp to pay me on 1099(instead of W2). Can it be possible and also can I avoid opening LLC. Also, not sure if in the near future if I get a RFE how that would go with current situation

If your petition has been physically "Mailed" to the Atlanta Service center . Do they give you a tracking number . Can such cases be viewed online on the website http://www.plc.doleta.gov ? How much time does the Atlanta service center take to acknowledge the reciept of such application ?

- My LC (EB3) got approved on July 2007, PD is March 2007 - Company A
- My I-140 and I-485 were filed concurrently on July 2007 - Company A
- I work as a contractor and my client (Company B) is offering me a full-time job and would like me to join on Sept 2007
- I still have 4 years on my H1B
With the assumption that my current employer (Company A) will give full cooperation on my current GC process, if I join company B on H1B transfer now, can I possibly invoke AC21 later after my I-140 gets approved and I-485 is pending for more than 180 days?
I'll greatly appreciate any comments.
