You EAD or AP may be approved at anytime while your 485 is pending, it is a derivative benefit of the pending 485 petition. If the 140 is rejected then everything collapses like a stack of dominos.

Dianne Feinstein (D-Calif.) went to the Senate floor to call for unanimous consent on a common-sense bill that would require candidates to file their campaign finance reports electronically. And just as he or she did on April 17, Sen. Ima Luddite (R-Who Knows Where) voiced opposition. This time the mouthpiece was Sen. Jim Bunning (R-Ky.). "On behalf of the Republican side," he said, "I object." We object to the obstruction.
Honestly, what is the big deal here? Filing campaign finance reports electronically has been standard operating procedure for candidates for the House of Representatives and the White House for years -- as it has been for political parties, political action committees and "527" groups. Yet Senate candidates are still trudging down to the Senate Office of Public Records with paper copies of their reports, which are then passed along to the Federal Election Commission, which sends them to a vendor that punches in the information and zaps it back to the FEC electronically. That finally makes them widely available, sometimes too late for voters to see who's donating to whom and how the money is being spent. With this seeming fear of modernity, it's a wonder the Senate isn't calculating budgets with an abacus. Or is it a fear of disclosure?
After the bill was blocked, Ms. Feinstein, chairman of the Senate Rules and Administration Committee, said, "It is very hard for me to understand who could oppose this and what their reason for opposing it could be." It is very hard for us, too. Sen. Luddite -- whoever he or she may be -- should come out of the shadows and explain the irrational fear that is keeping the Senate from joining the rest of us in the 21st century. The infamous unnamed senator (or senators) has for more than a week blocked passage of legislation that would require Senate candidates to file campaign finance reports electronically.
Electronic filings would make the names of campaign donors readily available -- it's how members of the House and presidential candidates have been doing it for years. When Sen. Russell Feingold (D-Wis.) first brought the bill to the floor last week, though, he was told that an unnamed lawmaker objected.
Long-standing Senate custom allows the objection of a single senator to stop a bill in its tracks -- it's known as a secret hold. A measure that passed the Senate earlier this year, and awaits a House vote, would eliminate the practice.
The hold unleashed a torrent of activity on the Internet, as bloggers tried to flush out the identity of the senator responsible for the hold. But after an onslaught of phone calls to Senate offices, the bloggers have no answer. No one owned up to being the culprit.
Yesterday, the bill's sponsor tried again. And again, the Republican floor leader objected. A spokesman for Senate Minority Leader Mitch McConnell (R-Ky.) said he is sure the name of the secret senator is known "in the cloakroom," but he said that misses the point.
"A hold can't stop something from coming to the floor," Don Stewart said. "It can only stop it from being pushed through without a full and open debate on the bill."
That's true -- sponsors had been trying to pass the bill by unanimous consent, which does not permit amendment or debate. But Feingold told the liberal blog Daily Kos that the path was typical for a bill with 35 bipartisan co-sponsors that did not elicit a single objection in committee.
Writing on the blog yesterday, Feingold said: "The fact is that someone anonymously blocked the bill, . . . that person has made no effort to resolve his or her concerns with us, and the Republican leadership won't even tell us who that person is."

Hi All,
I have a question regarding my wife's H1B Status.
My wife got H1B stamped in hyderabad consulate last year. Due to recession, she applied for H4 to join me in US, got H4 stamping in hyderabad, during which
H1 Visa was cancelled[expected..]. we have H1B Petition docs which says it is valid for 3 years. My wife came to US on H4.
Now can't she apply for Change of status from H4 to H1 as we have petition docs, which are valid for 3 years?
when contacted the actual employer, they said, when H1 visa is cancelled, it means, H1B petition also cancelled. Is it true?
Please suggest.

I have read in the popular immigration forums that one can request a one time 3 year extension to H1b beyond the standard 6 year limit if one has an approved I140 and could not file I485 due to retrogression. I am confused on how does one go about requesting this..meaning is it sufficient to just put three years under the 'date of intended employment' in I129 form and have a labor condition approval with similar dates or do you have to include a copy of approved I140 and point to the 2005 Aytes memo that grants such a provision while you file for I129. By the way the situation is also a bit more complicated due to the fact that I am changing jobs (5th year H1) and trying to get a 3 year transfer based on approval from the company I am leaving.

How can we help ourselves to get 2 year AP ? IV admins, can you kindly share with us any info regarding this ?
I know at this moment everyone is looking at the stimulus plan and economy, but , in the mean time we can prepare ourselves with some plan of action...
May be we should push for 3 year EAD/AP . Our argument should be, if we are 3 or more years away ( like EB3 India is currently 2001 or something ), we should get 3 year EAD/AP
Not meant to talk only for EB3 community, but in general as well.
Any thoughts IVians ?

I am EB3 and recently got my h1-b extension from 10th to 13 year and got approved without any RFE in 2months from VSC.approved in 3rd week of january.i am working for the same company since 2002 an I am permanent employee not consultant and no clients
Now all the sudden out of nowhere an immigration inspector came to our workplace and asked details about my work, salary. They didn't ask anything else. They asked about me but I was working from home that day an per hr its related to h1-b but they have no clue as i am the only one non immigrant in 1600 employees
Is this common?
Should I enquiry with uscis? If so how
Since I worked from home that day and didn�t meet me, will there be an issue?

I had been in H-1B status and was laid off. My H-1B was withdrawn by my company on 12/31/2010. I applied for COS to B2 and received the USCIS receipt notice on Dec 17th, a few days before my H-1B was withdrawn.
Later on Feb 2nd, 2011, I received the approval notice from USCIS for B2 valid from 02/02/2011 to 04/29/2011(I had informed in my application that this would be my date of departure.) My question is: What status would I be from the date my H-1B was withdrawn till the B2 validity start date?

I just checked that Nebraska is now processing cases from August 2007 for I 140 applications. Do these also indicate China and India?
My pd for I 140 is in July, and I am from india. Should I be able to make a query since the dates have gone past my PD?

My I-140 was approved April 30,2007. The appoval letter indicated that not yet elligible for change of status. The I-485 was returned together with the checks we paid. Please clarify and what can I do next other than waiting?
