Hi,
I have got my EAD and want to do part time job as well as work on H1 for the employee who sponsored my GC, What is my status? I am still on H1 or AOS? I would be glad if someone can reply!
If you use your EAD (for part time or full time), you are on EAD and your H1B status is gone. It does not matter that you primary job is still on H1B.

Hi,
I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:
1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.
2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.
3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.
4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.
Am I missing anything? Thanks.

Hi,
My H1B was approved with a start date of 12th Dec 2010. However, the paperwork for the position has not been completed as yet by the HR of my employer and now they tell me that the start date of my position will be around the middle of Jan 2011.
This means that I will not get paid till the actual start of my position. So what is my legal status right now.
I have been told that on a H1B visa, If I am not working and getting paid for the position I was approved for, I am illegal.
Please advise me as I still have time to convey the issues to get the paperwork done right. What happens if my H1B start date is the 12th of Jan and my job paperwork shows position and pay from the 15th of Jan?

one of my friend (EB2@TSC - India PD 2001) didnt see anything happen after the infopass ... YET

I signed an employment agreement stating that if I had to leave my employer before getting my Green Card that I will be liable for all the fees pertaining to the Green Card application which my employer has been paying for while I am been employed by him.
I have heard that an employer cannot hold Green Card fees over an employee. I also believe if anything, the fees owing should drop according to the length of time that the employee has worked for that employer.
I have been with my current employer for 4 years now and I wish to leave him but I do not want to pay him for the Green Card fees as I believe that should be a business expense to him.
I would just like to know what are my rights in the above case

I have a question. My wife called TSC today, and she talked to one of the most rudest person in the world. unfortunatelly she forgot to write his information down.
Baiscally, while she was talking my son was bothering her and cryin in a low pitch. The bastard TSC agen had the odesity to tell my wife to take the kid away, and htat is he dying.. you should got help him. Obviouslly he was not saying that because he was nice. He started to laguh. I am so furious right now.
So my question is can we find out who this agent was by callin INS and asking them who opened her file last. I sure would love to have few minutes with him one on one. Show him what we do to peace of crap like him if we was back home.
Anyhows, appreciate your answers.

If it has been more than 90 days for the EAD renewal application and the EAD is about to expire, what can one do? I know they no longer give walk-in EADs. I have tried to contact them but no positive response. Any help would be appreciated.

For how long you are waiting for GC and for how long you are willing to wait more for GC?
A lot of people have been for a long time. That is the reason IV has formed to eliminate/minimize the wait.
I don't think any one is willing to wait here !!!!

Hello All,
The officer at the SSN issuing center told me since my passport and the stamped I-94 have my maiden I will get an SSN also in the maiden name and not my married name.
However I had already filed for my EAD (form I-765) before getting this information with my married name which I need to change to the maiden name. I have received an appointment letter for biometrics/finger printing (FP) . What should be done now? Should I wait and tell the officer during the FP about this name change that I need or how should I go about it?

I have applied EAD for my wife... while applying I misspelt my wife's first name and I haven't selected any service center, seems it automatically choosen NSC... but my 485 applied under TSC and the dates here are best like May 20, 2008 and the NBC is Mar 31, 2008...
How can I correct the name, can I do it at the time of finger print?
How can I change the service center?
I already sent email to EAD Deptt... In the meanwhile, I wd like to find from many experienced people like you...
